General terms and conditions for online ticket sales
Article 1: Ticket sales, offers, and prices
Article 1.1: All quotations, announcements, or information otherwise provided by the Zaans Museum are binding. The Zaans Museum accepts liability for any errors made by the museum itself in the quotations, announcements, or information otherwise provided to visitors. However, this liability applies only to the Zaans Museum’s own information material that is present in the museum when the claim is made, or that has been recently distributed by the Zaans Museum or on its behalf. The Zaans Museum is not liable for errors that are due to intentional acts, wrongful acts, or the negligence of third parties.
Article 1.2: If requested, visitors must always show their admission ticket, and any card or voucher entitling them to a discount on the admission charge, to officials who are recognisable as such, including but not limited to attendants.
Article 1.3: Potential visitors are not entitled to a refund on the admission charge or to any other compensation in the event of loss or theft of the admission ticket before they have entered the museum complex. If potential visitors do not use the pre-purchased admission ticket, this will be at their own expense and risk. The same applies if the admission ticket is valid only for a specific time and/or date. The admission charge will not be refunded. The admission charge may be refunded if circumstances beyond the purchaser’s control render the museum visit impossible. However, this will be at the management’s discretion.
Article 1.4: Potential visitors may be refused admission to the museum complex if it transpires that their admission ticket, discount card, or voucher has not been purchased from the Zaans Museum or from an agency authorized to act on the Zaans Museum’s behalf.
Article 2: Complaints and claims
Article 2.1: The Zaans Museum shall do its utmost to ensure that a visit to the museum complex or to the exhibitions and activities organized by the Zaans Museum takes place in accordance with the published offer. This includes the obligation to inform the public in the best possible way about the whole, partial, or early closure of the museum complex and/or exhibitions organized by the Zaans Museum. The Zaans Museum shall further inform potential visitors about any maintenance work, renovations, or the fitting out and refurbishment of spaces that could cause disturbance. Visitors can never derive any right to compensation from such a disturbance.
Article 2.2: Claims cannot be made in relation to the following complaints and circumstances that the Zaans Museum is unable to avoid, and therefore will never lead to any obligation on the museum to pay compensation to visitors:
a. complaints concerning items from the Zaans Museum’s permanent collection not being on view;
b. complaints concerning the partial closure of the museum complex, including but not limited to partial closure as a result of setting up or taking down exhibitions;
c. complaints and circumstances relating to any disturbance or inconvenience caused by other visitors, including but not limited to any noise disturbance, inappropriate conduct, theft, and wilful damage;
d. complaints and circumstances relating to any disturbance or inconvenience caused by maintenance work, including but not limited to renovation or the fitting out or refurbishment of spaces;
e. complaints and circumstances relating to any disturbance or inconvenience caused by facilities in the museum complex not functioning properly.
Article 2.3: Complaints and refund requests concerning the agreement between the Zaans Museum and the visitor must be submitted in writing to the Zaans Museum within six weeks of the visit. Complaints and refund requests submitted after this period will not be processed.
Article 2.4: The Zaans Museum shall investigate the complaint and respond in writing within 30 days of receipt. If the investigation has not been completed within this period, the complainant will be informed and notified of the expected completion date.
Article 2.5: Visitors may submit complaints, claims, and suggestions for improvement in writing.
Article 3: Liability of the museum
Article 3.1: The Zaans Museum can never be held liable for any damage or loss arising from quotations, announcements, or other forms of information provided by it and/or third parties to visitors, except if and insofar as such damage or loss is the direct result of an intentional act or the gross negligence of the Zaans Museum and/or its employees.
Article 3.2: Visitors visit the museum complex at their own expense and risk. The museum is liable for damage to property, consequential loss, or injury caused to visitors only if this arises directly and solely from an intentional act or the gross negligence of the museum, on the understanding that visitors will be entitled only to compensation for such damage, loss, or injury that the museum is or should have been insured against in accordance with standards of reasonableness and fairness.
Article 3.3: The Zaans Museum is not obliged in any case to pay a higher amount of compensation than:
a. the admission charge actually paid and the travel costs actually incurred, or, if higher;
b. the amount paid by the insurer of the Zaans Museum to the Zaans Museum in respect of the damage, loss, or injury; or
c. the compensation obtained from another third party in respect of the damage, loss, or injury.
Article 3.4: The Zaans Museum can never be held liable for any damage caused to visitors’ vehicles, except if and insofar as the damage has arisen on or in the museum complex and is the direct result of an intentional act or the gross negligence of the Zaans Museum and/or its employees.
Article 3.5: The Zaans Museum can never be held liable for any direct or indirect damage or loss arising directly or indirectly from any defect, quality, or condition relating to, in, or on any property of which the Zaans Museum is the holder, leaseholder, tenant, or owner, or which is otherwise at the disposal of the Zaans Museum, except if and insofar as the damage or loss is the direct result of an intentional act or the gross negligence of the Zaans Museum and/or its employees.
Article 3.6: If the Zaans Museum takes receipt of goods or if goods are deposited, held in storage, and/or left behind anywhere, in any way, and by anyone without the Zaans Museum stipulating a fee for that purpose, the Zaans Museum can never be held liable for any damage to or in connection with goods that arises in any manner, unless it has intentionally caused the damage, or the damage is the result of the gross negligence of the Zaans Museum.
Article 3.7: The Zaans Museum’s total liability for an attributable failure to perform the visit agreement is limited to the compensation of direct damage or loss and will not in any case exceed the arrangement for compensation as described in 3.3 above.
Article 3.8: The Zaans Museum’s total liability for loss arising from death or physical injury will not in any case exceed the arrangement for compensation as described in 3.3 above.
Article 3.9: The Zaans Museum’s liability for indirect damage or loss, including consequential damage, lost profit or salary, lost savings, etc. is excluded.
Article 3.10: The maximum amounts specified in Article 3.3 will cease to apply if and insofar as the damage or loss has arisen from an intentional act or the gross negligence of the Zaans Museum and/or one of its officers.
Article 4: Force majeure
Article 4.1: Force majeure in respect of the Zaans Museum means that any consequential breach cannot be attributed to the Zaans Museum and entails every unforeseen circumstance that hinders the performance of the agreement by the Zaans Museum in such a way that the performance of the agreement is rendered temporarily or permanently impossible or onerous.
Article 4.2: Such circumstances include those involving people and/or services, and/or institutions that the Zaans Museum uses for the performance of the visit agreement, all matters that qualify as force majeure or as conditions precedent or subsequent for the above parties, as well as an attributable breach of the above parties.
